Official Rules and Regulations
These Official Rules & Regulations govern the conduct of the 2024 Christ the King Oktoberfest Raffle (hereinafter “Raffle”) and, together with the decisions of Christ the King, are binding on everyone who purchases a Raffle ticket and/or who is named on a Raffle ticket. The Raffle is a fundraising activity conducted by Christ the King in support of the Cathedral of Christ the King, Christ the King School and community outreach efforts selected by the Cathedral of Christ the King. These Official Rules & Regulations may not be waived, modified or supplemented unless such waiver, modification or supplementation is made in writing by Christ the King.
Grand Prize Drawing
The Grand Prize drawing for the Raffle will be held on Saturday, September 21, 2024, at 9:00 p.m. Eastern, on Facebook Live, except this date and all other dates stated in these rules may be extended at the absolute discretion of Christ the King. In the event the Raffle is postponed, all reasonable efforts will be made to notify ticket holders of the new drawing date. On-line ticket orders must be received before 7:00 PM Eastern Saturday, September 21, 2024. Tickets may sell out before that time. The drawing will be conducted under the supervision of Christ the King. The winning ticket will be drawn at random from a drum containing all eligible Raffle tickets. The drawing will be held on Facebook Live and viewable by the public at https://www.facebook.com/ctkokt.
The price per ticket is $50.00. Gaming Officers of Christ the King are not eligible to participate.
Grand Prize
The Raffle winner will receive their choice of one of the two following prize options; (1) a 2025 Buick Encore GX, or (2) $25,000 cash. Vehicle availability may change at the time winner is selected. Dan Cummins will provide a $25,000 credit to new or used vehicles at Dan Cummins. Winner forfeits any credit for vehicle less than $25,000.
Christ the King does not undertake to give advice on the legal or tax consequences of the Raffle or its winner. However, it understands that the IRS position is that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts and, consequently, do not qualify as deductible charitable contributions.
By participating in this Raffle, all ticket purchasers and the person named on each Raffle ticket accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here, and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by Christ the King for publicity purposes and naming of the Grand Prize winner to be published in area newspapers or other media including television, radio, web and print. The Grand Prize winner will be published on the Christ the King Oktoberfest, Christ the King School and the Cathedral of Christ the King social media channels and associated websites. The name of the winner may be obtained by sending a written request plus a self-addressed, stamped envelope to Christ the King School, 412 Cochran Road, Lexington, KY 40502. Christ the King’s interpretation and application of the rules and regulations shall be final.
By participating in this Raffle, each participant releases the Cathedral of Christ the King, Christ the King School and each of their respective members, directors, officers, employees and agents from any and all liability for injuries, losses or damages of any kind, including, but not limited to, liability for injuries, losses, or damages arising from or caused by any prize or resulting from acceptance, possession, use or misuse of any prize; and each winner agrees to indemnify and hold Cathedral of Christ the King, Christ the King School and each of their respective members, directors, officers, employees and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize.
Eligibility
The Raffle is open to the general public, and ticket purchasers and the person named on the Raffle ticket must be at least 18 years of age at the time of purchase. The Grand Prize winner may be required to sign an affidavit of eligibility. Gaming Officers of Christ the King are not eligible to participate. Offer void where prohibited by law.
In order for the Grand Prize winner to receive their prize (subject to the other provisions in these rules), the Grand Prize winner must elect to receive the prize by delivering written notice of that election to Christ the King, by October 21, 2024. Christ the King shall notify the winner by certified mail within seven (7) days of the drawing that the winner shall claim the prize within thirty (30) days.
If a winner does not wish to claim the prize but wishes to donate it to Christ the King for the benefit of the Cathedral of Christ the King, Christ the King School and community outreach efforts, the winner shall provide Christ the King with a written statement within the thirty (30) day period stating that the winner wishes to donate the prize for the benefit of the Cathedral of Christ the King, Christ the King School and community outreach efforts. A prize winner shall not donate the prize back to Christ the King if to do so would violate KRS 238.540(7).
If the Grand Prize winner does not claim the prize or donate it to Christ the King within thirty (30) days after having been contacted, Christ the King shall notify the Department of Charitable Gaming and draw another ticket in the presence of Department personnel. The tickets shall remain under the control of Christ the King until another Grand Prize winner is identified and accepts the prize.
Refunds
All Raffle ticket sales are final. No other refunds are available. Christ the King assumes no responsibility for any failure to receive orders prior to the drawing deadlines. A Raffle participant’s sole and exclusive remedy for Christ the King’s breach shall be limited to the return of the purchase price paid for his or her Raffle ticket(s). In no event shall Cathedral of Christ the King, Christ the King School or their respective directors, officers, employees, members, committee members, agents, contractors, advisors, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.
Tickets
Tickets are $50.00 each. Raffle tickets may be purchased exclusively online from Christ the King at https://raffle.ctkoktoberfest.com/.
You may buy as many tickets as you wish, subject to availability, until a maximum of 2,000 tickets are sold. Each Raffle ticket will be entered separately in the drawing. Each Raffle ticket is a separate and equal chance to win the Grand Prize.
All sales are final. If the credit card transaction is denied for any reason, no ticket shall be sold, and the ticket purchase request is null and void. The purchaser will be notified immediately of the problem, and the next ticket order in line will be processed.
Ticket And Payment Verification
Christ the King reserves the right to reject any ticket request form that is submitted with payment that does not constitute “good funds.” All defective or physically altered request forms are subject to disqualification at the discretion of Christ the King. Prior to the Grand Prize drawing, Christ the King will make a reasonable effort to notify any individual who submits such an entry form, or one which has been rejected because the credit card or check did not clear, that the entry has been rejected. All requests for tickets for the drawing must be received and/or purchased by the indicated deadline.
Grand Prize Winner
Winner notification will be made by telephone, email, US mail and posted on the web page. The winner will need to provide proper identification to the satisfaction of Christ the King. A representative of Christ the King will assist in coordinating all the details with the winner regarding the Grand Prize. Winner agrees to the use of his/her name, photograph or videotape likeness and statements for publicity purposes by Cathedral of Christ the King and Christ the King School and agrees to sign a publicity release without any further compensation.
The Grand Prize winner assumes and must pay all income taxes, local, state and federal taxes associated with the value of the prize won. Christ the King assumes no responsibility for a prizewinner’s tax obligations. The Grand Prize winner will be required to pay federal and state tax withholdings for the fair market value of the Grand Prize to Christ the King before the Grand Prize will be released to the Grand Prize winner. The Grand Prize winner is strongly advised to seek professional legal or tax advice. Award of the Grand Prize could have material adverse consequences on the Grand Prize winner, including, without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters. Forms W-2G & 941 will be filed with the Internal Revenue Service to report the value of the prize won. The Grand Prize winner will also receive a copy of these forms. This offer is void where prohibited by law; and all federal, state and local laws and regulations apply.
Prize Awards In Event Of Non-Sellout Of Tickets
A maximum of 2,000 tickets will be sold. If fewer than 2,000 Raffle tickets are sold, Christ the King reserves the right, in its absolute discretion, to postpone the date of the drawing until a date that is within seven (7) days from the date on which 2,000 tickets have been sold. Christ the King reserves the right to cancel this Raffle contest at any time, in which event liability is limited to the refund of the ticket price to all participants.
Registration With The State Of Kentucky
This Raffle for the benefit of the Cathedral of Christ the King, Christ the King School and community outreach efforts selected by the Cathedral of Christ the King, and licensed by the Department of Charitable Gaming, License Number ORG 0000731.
